This Privacy Policy describes how we collect, use, disclose, and protect the personal information of drivers and users who use YOUDRIVE ETHIOPIA app. Please read this Privacy Policy carefully before using our app to understand how your personal information will be treated.

Introduction:

YOUDRIVE ETHIOPIA (“company”, “we”, “us”, “our”) is a technology platform service that enables users of YOUDRIVE ETHIOPIA’s mobile applications, call center or websites provided as part of the services and does not provide transport or logistic services or function as a transportation carrier. Transport services are provided by drivers under a contract (with you) for the carriage of passengers. Drivers provide transport services on an independent basis as professional service providers and are not employed by YOUDRIVE ETHIOPIA. Disputes arising from consumer rights, legal obligations or from law applicable to the provision of transport services will be resolved between the passengers and drivers. Data regarding the drivers and their transport service is available in the YouDrive Ethiopia app.

The term “you” or “your” refers to the passenger or driver who requests, hires and/or receives a transportation service through their YOUDRIVE ETHIOPIA app account.

1. Information We Collect:

1. Information Provided by You: When you sign up for our app as a driver or user, we collect information such as your name, email address, phone number, payment information, profile picture, and any other information you provide voluntarily.
2. Location Information: We collect your precise location information when you use our app to provide services. We may also collect your approximate location information based on your IP address or other available data.
3. Device Information: We collect information about the devices you use to access our app, including the type of device, operating system, unique device identifiers, mobile network information, and IP address.

2. The app may record audio and video during the ride, including inside the vehicle, for the purpose of monitoring and responding to any safety-related incidents.

7. User Consent and Privacy:

1. As a user of the YOUDRIVE ETHIOPIA app, you acknowledge and agree to be recorded by the video surveillance and camera system during the ride.
2. The recorded data may be used by the YOUDRIVE ETHIOPIA company to address safety concerns, investigate reported incidents, and improve services. It will be treated in accordance with the YOUDRIVE ETHIOPIA app's privacy policy.
3. The YOUDRIVE ETHIOPIA service app will not use the recorded data for any purposes other than those stated in the privacy policy, unless required by law.

8. Driver Responsibilities:

1. Drivers using the YOUDRIVE ETHIOPIA app must ensure that the video surveillance and camera system is properly installed and maintained in their vehicles.
2. Drivers should inform passengers about the presence of video surveillance and camera systems in the vehicle.
3. Drivers should not tamper with or disable the video surveillance and camera system, except as required for maintenance or repair with appropriate authorization.

9. Prohibited Activities:

1. Users and drivers must not use the video surveillance and camera system for any illegal, unethical, or unauthorized purposes.
2. Users and drivers must not attempt to access, retrieve, or manipulate the recorded data without proper authorization.
3. Users and drivers must not use the recorded data to infringe upon the privacy or rights of others.

10. Liability and Disclaimers:

1.  The YOUDRIVE ETHIOPIA app and its operators are not responsible for any loss, damage, or unauthorized use of the recorded data.
2.  The YOUDRIVE ETHIOPIA app and its operators are not liable for any actions taken based on the recorded data, except as required by law.
3.  As the YouDrive Ethiopia app is an information society service (a means of communication) between passengers and drivers, we cannot guarantee or take any responsibility for the quality or the absence of defects in the provision of transport services. As the usage of our app for requesting transport services depends on the behavior of the drivers, YouDrive Ethiopia does not guarantee that you will always have offers available for the provision of the transport services.
4.  The YouDrive Ethiopia app does not offer or broker transport services for passengers. It is also not a transport agency service for finding passengers for transport providers. The YouDrive Ethiopia app is used as the means for organizing the provision of transport services.
5.  The YouDrive Ethiopia app is provided on an "as is" and "as available" basis. YouDrive Ethiopia does not represent, warrant or guarantee that access to YouDrive Ethiopia app will be uninterrupted or error free. In case of any faults in the software, we will endeavor to correct them as soon as possible, but please keep in mind that the functioning of the app may be restricted due to occasional technical errors and we are not able to guarantee that the app will function at all times, for example a public emergency may result in a service interruption
6.  YouDrive Ethiopia, its representatives, directors and employees are not liable for any loss or damage that you may incur as a result of using YouDrive Ethiopia app or relying on, the journey contracted for through the YouDrive Ethiopia app, including but not limited to: any direct or indirect property damage or monetary loss; loss of profit; loss of business, contracts, contacts, goodwill, reputation and any loss that may arise from interruption of the business; loss or inaccuracy of data; and any other type of loss or damage.
7.  YouDrive Ethiopia will not be liable for the actions or inactions of the driver and will not be liable for damages that the driver causes to the passengers.
8.  You agree to fully indemnify and hold YouDrive Ethiopia, their affiliate companies, representatives, employees and directors harmless from any claims or losses (including liabilities, damages, costs and expenses of any nature) that they suffer as a result of your use of the YouDrive Ethiopia app (including the journeys you obtain through your use of the YouDrive Ethiopia app) related to:

• Your breach of the Agreements or any one of them;
• Any User Content you post or otherwise contribute;
• Any activity in which you engage on or through the YouDrive Ethiopia Service; and
• Your violation of any law or the rights of a third party.

1.  The YOUDRIVE ETHIOPIA app and its operators reserve the right to suspend or terminate access to the app in case of violation of these terms and conditions or we consider it necessary to protect the integrity of YOUDRIVE ETHIOPIA or the safety of users and drivers.

11. Children's Privacy:

You must be 18 years or older to have an YOUDRIVE ETHIOPIA account; That means that you must be at least 18 years old to YOUDRIVE ETHIOPIA unaccompanied in a vehicle; Account holders can’t request a trip for someone under the age of 18 who will not be accompanied by either the account holder or another adult during the trip.

Our app is not intended for individuals under the age of 18. We do not knowingly collect personal information from children.

12. Use of YOUDRIVE ETHIOPIA app:

 As long as you comply with these General Terms and Conditions, we agree to grant you a limited, non-transferrable, revocable, non-exclusive, right to access and use the YOUDRIVE ETHIOPIA app in accordance with these General Terms and Conditions, the Privacy Notice and the applicable app-store terms. You may not transfer or sub-license this right to use the YOUDRIVE ETHIOPIA app. In the event that your right to use YOUDRIVE ETHIOPIA app is cancelled, the corresponding non-exclusive license will also be cancelled.

You may not:

• remove any copyright, trademark or other proprietary notices from any portion of the Services;
• reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by YOUDRIVE ETHIOPIA;
• decompile, reverse engineer or disassemble the Services;
• link to, mirror or frame any portion of the Services;
• cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services; or
• attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks.

13. Changes to this Privacy Policy:

We may update this Privacy Policy from time to time. We will notify you of any material changes through the app or other communication channels. Your continued use of the app following the changes constitutes your acceptance of the updated Privacy Policy.
